EU GPSR・PLDの開始とその影響について

「欧米での安全関連法などの最新情報（PDF） ＞＞」

1. EUおよび日本の規制開始状況

2025年12月13日より、EUにおいて 一般製品安全規則（GPSR） が施行されます。
また、EU改正PL法（PLD）は2026年1月より順次開始され、2027年内にEU全域で適用 されます。
一方、日本国内では、これら2つの規制を横断的に解説した資料や具体的影響について、
現時点で体系的整理はほとんど行われていません。
経済産業省はすでに 製品安全関連4法（PS：Product Safety） の改正を本年12月に施行し、とくに リチウムイオン電池を含む製品の回収義務に関する事業者責務 を大幅に強化しました。

The General Product Safety Regulation (GPSR) will come into effect in the EU on December 13th, and revisions to the Product Liability Act (PLD) will take effect across the EU from January 2026 through 2027.
Meanwhile, in Japan, there is almost no integrated information that covers both of these regulations or explains their specific implications.
The Ministry of Economy, Trade and Industry (METI) has already revised the Product Safety Act (four product safety-related laws) in December and will begin imposing strict business responsibilities regarding the recall of products that use lithium-ion batteries.

2. 製品リコールのできない製品は販売不可となる

製品リコールを実施できない製品は「品質欠陥」と判断され、販売できません。

This means that products that cannot be recalled are deemed to have quality defects and cannot be sold.

3. PL研究学会としての整理と公開方針

PL（製造物責任）の専門研究学会として、EU GPSR・PLDの学術的背景と実務への影響を整理し、製品リコール研究部会としての最新の分析結果を以下の関連論文とともに公開いたします。
併せて、米国 食品安全強化法（FSMA） の最新動向および対応システムに関する調査報告も含みます。
ご意見や情報提供などございましたら、当学会事務局までお寄せください。

As a professional research society for product liability, we have compiled the academic background and practical impact of this regulatory revision.
As the Chair of the Product Recall Research Division, we are publishing the latest findings along with the related papers listed below.
We also report on trends and response systems related to the U.S. Food Safety Modernization Act (FSMA).

「欧米での安全関連法などの最新情報（PDF） ＞＞」
EU改正PLDおよびGPSRは、製造者・輸入者・DPF（Digital Platform）および越境EC販売者に対し、高度な安全情報提供義務 を必達要件としています。

■ 主要な義務（Requirements）

• GTIN と LOT によるトレーサビリティが必須
• 通知責任と通知証跡の保存、および対象ロットの製品データの即時提出義務
• ソフトウェア（クラウドサービス）も PL 法の適用対象
• 安全情報・リコール情報を「使用者へ即時通知したことを証明」できなければ欠陥と判断される

• Traceability by GTIN and lot is required.
• Responsibility for notification, documentation of notification, and immediate submission of product data for the affected lot.
• Software (including cloud services) is subject to the Product Liability Act.
• Failure to prove that safety information or recall notices were promptly communicated to users constitutes a defect.
